The condition to read twice: no whale, no refund
Air Kaikoura states it explicitly as a product condition: if no whale is sighted, there is no refund and no rescheduling. The flight itself is the product — the canyon, the coastline, the Seaward Kaikōura Range, and a strong probability of whales, but the probability is what you buy. The reviews bear this out from both sides: travellers describe pilots circling hard to find a whale, and a minority of flights end without one. Wings Over Whales states no policy either way on its listing; if the answer would change your booking, ask them first.
This is a real difference from the boat, whose operator advertises a partial refund on whale-free cruises. Do not carry that promise into the air — it belongs to the boat alone.
